De Facto and Same Sex relationships
Following the breakdown of a de facto relationship or same sex relationship the Family Law Courts have jurisdiction to make orders for property settlements and maintenance under the Family Law Act 1975 (Cth). These Courts can also deal with matters relating to children.

There may be a dispute about whether a de facto relationship existed in order to give rise to these rights. Although typically there may be a de facto relationship where you have lived together for more than two years or have a child, the Court considers many factors and in some cases a de facto relationship can exist even where the parties did not share a common residence.
